I am pleased to present the Canadian Grain Commission’s report on fees for 2021–22.

The Canadian Grain Commission continued to modernize fees and services in accordance with the Service Fees Act. I want to commend this dedication to ensuring that fees reflect the cost of providing services, and the provision of clear service standards and performance results.

Reflective of this work was the Canadian Grain Commission’s reduction of fees collected for four official inspection and official weighing services, effective August 1, 2021. These four fees were reduced by 29 percent and realigned with the adjusted grain volume forecast of 48.10 million metric tonnes. This adjustment was in response to the sustained growth in grain export volumes in recent years and will contribute to the prosperity of Canadian grain producers.

Additionally, the Canadian Grain Commission’s Remission Policy came into effect August 1, 2021. Through this policy, the Canadian Grain Commission became compliant with the Service Fees Act requirement to issue a remission to a fee-payer if it is determined that a performance standard, in relation to a fee, has not been met.

I also commend the Canadian Grain Commission’s efforts to meet the needs of Canadian farmers and the Canadian grain sector during the historic drought in 2021-22. The Canadian Grain Commission continued to support grain farmers in the face of this adversity through its programs and services. For example, the Canadian Grain Commission’s grain quality research and testing supported Canadian market access efforts, and the department provided vital protections for farmers owed money by grain companies experiencing financial difficulties.

As Canada’s Minister of Agriculture and Agri-Food, I will continue to support the Canadian Grain Commission in transparent reporting and fee modernization under the Service Fees Act. Together we will further contribute to a prosperous and sustainable future for grain producers and the entire value chain.

As Chief Commissioner, I am incredibly proud of how hard Canadian Grain Commission staff all across the country work to benefit grain farmers, the grain sector, and all Canadians. The hard work and dedication of all Canadian Grain Commission staff is demonstrated through our service standard performance results, which I invite you to explore throughout this report.

The Canadian Grain Commission is funded largely through a revolving fund, which is based on charging fees for services and licences. Our fees are fixed by regulation and fees notice and are adjusted for inflation annually in accordance with the Service Fees Act. However, the Canadian Grain Commission must continue to be as dynamic as the Canadian grain sector it serves and has committed to review fees on a five-year cycle, or as required, to ensure that fees remain aligned with the cost of service provision.

Effective August 1, 2021, the Canadian Grain Commission reduced four official inspection and weighing fees based on an adjusted grain volume forecast of 48.10 million metric tonnes for the next three-year period. The reduction was in response to the continued increase in grain production and record grain export volumes, and will limit the possibility of additional surplus accumulation going forward.

The Canadian Grain Commission furthered its commitment to transparency and Service Fees Act compliance by introducing a Remission Policy, effective August 1, 2021. I am pleased to say that it was determined that only two performance standards, in relation to applicable fees, were not met.

In 2021-22, a historic drought affected the entire Canadian grain sector and resulted in significantly decreased yields and exports. As such, the volume of grain inspected and weighed by the Canadian Grain Commission was lower than the recent adjusted forecast, contributing to a revenue shortfall and necessitating a draw down on the accumulated surplus from previous years.

I commend all Canadian Grain Commission staff who delivered results and provided support throughout the value chain during this difficult time. From grain quality testing to safeguarding the rights of farmers, our team continued to ensure that the Canadian grain sector remains viable and prosperous for generations to come.

About this report

This report, which is tabled under section 20 of the Service Fees Act, the Low Materiality Fees Regulations, and subsection 4.2.8 of the Treasury Board Directive on Charging and Special Financial Authorities, contains information about the fees Canadian Grain Commission had the authority to set in fiscal year 2021–22.

The report covers fees that are subject to the Service Fees Act and exempted from the Service Fees Act.

For reporting purposes, fees are categorized by fee-setting mechanism. There are three mechanisms:

  1. Act, regulation or fees notice
    • The authority to set these fees is delegated to a department, minister or Governor in Council pursuant to an act of Parliament.
  2. Contract
    • Ministers have the authority to enter into contracts, which are usually negotiated between the minister and an individual or organization, and which cover fees and other terms and conditions. In some cases, that authority may also be provided by an act of Parliament.
  3. Market-rate or auction
    • The authority to set these fees is pursuant to an act of Parliament or a regulation, and the Minister, department or Governor in Council has no control over the fee amount.

For fees set by act, regulation or fees notice, the report provides totals for fee groupings, as well as detailed information for each fee. For fees set by contract, the report provides totals only. The Canadian Grain Commission did not have fees set by market rate or auction

Although the fees the Canadian Grain Commission charges under the Access to Information Act were subject to the Service Fees Act, they are not included in this report. Information on the Canadian Grain Commission’s access to information fees for 2021–22 is in our annual report to Parliament on the administration of the Access to Information Act: Transparency.

Remissions

In 2021–22, the Canadian Grain Commission was subject to the requirements to issue remissions under section 7 of the Service Fees Act and subsection 4.2.4 of the Treasury Board Directive on Charging and Special Financial Authorities to remit a fee, in whole or in part, to a fee payer when a service standard was deemed not met. In 2021–22, the Canadian Grain Commission did not issue remissions under the Financial Administration Act. These remissions may be for reasons other than not meeting a service standard.

The other sections of this report provide detailed amounts on the Canadian Grain Commission’s remissions for 2021–22.

  1. The Canadian Grain Commission received approximately $6.4 million in 2021-22 in appropriation that is not included in the revenue.
  2. The Canadian Grain Commission operates primarily as a revolving fund, which has a continuing, non-lapsing authority from Parliament. This is a funding mechanism where revenues remain available in order to finance continuing operations without fiscal year limitations
  3. In 2021-22, the Canadian Grain Commission provided official inspection and official weighing on lower than anticipated grain volumes caused by extreme weather conditions. The revenue shortfall was covered by revolving fund surplus accumulated since 2018.

The Canadian Grain Commission operates as a revolving fund (a statutory, non-lapsing authority), which allows for services and licences provided in one fiscal year to have funds collected in a different fiscal year. The effects of this timing difference on reporting are:

  • a fee may have revenue in a fiscal year when the service standard indicates the service was not requested.
  • revenue and fee amounts may not align with units billed.
